Welcome, and thank you for your interest in DTS Fitness Education. When you use our products and services, you're agreeing to our "Terms of Service". Please read them carefully before registering for any online ("Learn Online") and in-person (“Learn In Class”) courses, workshops or events on https://www.dtseducation.com and all related subdomains.

DTS Fitness Education maintains this website, any courses offered and other linked and related sites (the “Site”) for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms fully and carefully before using the Site. Use of this website indicates acceptance of these “Terms of Service” and forms a binding agreement between you and DTS Fitness Education If you do not agree to these terms, do not use this Site.

LEARN IN CLASS

Course and Workshop Registrations

All "Learn in Class" registrations are non-refundable! No refunds will be issued for any course or workshop so please be sure that you can attend the dates and location of the workshop before you complete your registration. In special circumstances* only, a transfer can be applied if notification is received at least 2 weeks prior to the course date. Transfers in these special circumstances only are valid for 1 year. Transfers are subject to a $25 transfer fee due upon transfer. All requests for transfers must be submitted by email to: [email protected]

*Special Circumstances relate strictly to unforeseen circumstances and are approved at the discretion of DTS Fitness Education. Any cancellations of registrations within 2 weeks of the course date will be forfeited and not eligible for a transfer. Failure to attend a workshop will result in all remaining segments being denied to the registrant and all regular fees will not be refunded or transferable for future courses.

Agreement to Participate

Participation Waiver

Participation in all courses and workshops requires participants to agree to a waiver. You must indicate your agreement to a waiver before registering for a course or workshop.

Intellectual Property

You acknowledge that all printed materials provided to you including, but not limited to handout manuals, is the property of DTS Fitness Education. These printed materials are to be used solely by you and are not to be shared, duplicated or reproduced by me or anyone acting on your behalf.

Photographs and Media Consent and Release

You consent and authorize DTS Fitness Education or our agents to take photographs, videos, or other types of media productions that capture your image and/or voice. You authorize DTS Fitness Education to copyright and use these materials for any educational or promotional purposes without notifying you.

Electronic Communication

To enhance your learning experience and as part of your course registration you will receive electronic communication such as emails and text messages. This communication will provide access to your pre- and post-course materials, all course related information, updates as well as sales and marketing information. You always have the option to stop/unsubscribe from these messages. Please review our Privacy Policy to learn more about how we protect and use your personal information.

Course and Workshop Completion Requirements

Full attendance is required for all courses and workshops and all requirements outlined in the course description must be fulfilled successfully in order to receive your certificate of completion or certification.

Certificates

Certificates will be provided on the last day of the course or workshop (with the exception of Animal Flow® workshops). Your name will appear exactly as provided during registration. Please double check your spelling and include your professional name. An administration fee will apply for reprinted certificates.

Receipts

Receipts are automatically sent by email when participants register and pay online. Please be aware that spam filters can block email receipts. If you do not see your receipt within 5 minutes of your completed transaction, please check these filters!

LEARN ONLINE AND LEARN IN CLASS PRE- AND POST-COURSE MODULES

1. Use of Site

DTS Fitness Education provides various materials, information, quizzes, tests, questions, articles, news and other information on this and related sites and in courses offered through this site (the “Materials”). DTS Fitness Education also provides various materials available for download (the “Downloads”). Users may view and download (only when explicitly stated so) one copy of the Downloads. The Downloads may be downloaded and a maximum of one copy may be printed provided that Users make no modifications to the Downloads and retain all copyright and other proprietary notices contained in the original Materials on any copies of the Downloads. Users may not modify the Materials at this Site in any way or reproduce, share or distribute them. Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity. Any breach of these Terms of Service automatically terminates your authorized use of the Site.

2. User Warranty

As a User you warrant that you are not an agent or employee of any other fitness education company and the Site and Materials solely for the purpose of improving your own education and skills.

3. Trademark and Copyright

DTS Fitness Education, and certain other brands, trademarks, and service marks are marks of DTS Fitness Education and its affiliates. The Materials on this Site are copyrighted, and any unauthorized use of any Materials on this Site may violate copyright, trademark, and other laws.

4. Hyperlinks

Links to external websites are provided solely as a convenience to you. DTS Fitness Education has not reviewed all of these external websites, does not control and is not responsible for any of these sites or their content. If you decide to access any of the external websites linked to this Site, you do so entirely at your own risk.

5. No Warranty

The Materials provided at this site are provided “as is” without any warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. DTS Fitness Education further does not warrant the accuracy and completeness of the Materials at this Site. DTS Fitness Education may make changes to the Materials at this Site, or to the services and prices described in them, at any time without notice. The Materials at this Site may be out of date, and DTS Fitness Education makes no commitment to update the Materials at this Site.

6. Limitation of Liability

In no event will DTS Fitness Education, its suppliers, or other third parties mentioned at this Site be liable for any damages whatsoever (including, without limitation, those resulting from injuries, interruption of services or inaccurate information) arising out of the use, inability to use, or the results of the use of this Site, any websites liked to this Site, or the Materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. If your use of the Materials or information from this Site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof.

7. Applicable Law

The Terms of Service are governed by the laws of the province of Ontario, Canada. Failure to enforce strict performance of the Terms of Service of Use shall not be construed as a waiver of any provision or right. DTS Fitness Education may assign its rights and duties under the Terms of Service without notice to any party at any time.

8. Effective Date and Updates

The Terms are effective as of July 7th, 2017 and are subject to change without notice by DTS Fitness Education at any time. Please check for changes regularly. Your use of this Site after such changes constitutes your agreement to such changes.
